Consulting firm Accenture recently conducted a survey on online security and privacy in 13 countries. Brazil was the country most distrustful of data protection, even though the General Data Protection Law has been approved and will come into effect next year. In our country, 1,400 high-level executives and 10,000 employees at other levels were interviewed, 77% of whom reported concerns about how companies use their personal information. Another 76% said they fear that their sensitive data – race, ethnicity, political opinion, religion, philosophies, sexual orientation, genetics, biometrics, and health-related data – could be targets of cyberattacks. Episodes of massive data leaks like those of Cambridge Analytica and Facebook and other financial entities are a warning sign worldwide.

Who protects your data?

Brazil is one of the most落后的 countries in Latin America when it comes to data protection. Since 1999, Chile has had its law in force, while in Brazil the General Data Protection Law (LGPD) was only approved in August 2018 and is expected to come into effect next year. Since its creation, the LGPD has generated doubts among companies and citizens, who are unaware of the rights and obligations provided for in the law. In December 2018, Provisional Measure No. 869 was issued, which provides for the creation of the National Data Protection Authority (ANPD), responsible for oversight, warnings, fines, and also for raising awareness about the correct handling of personal information. The trend for the coming years is that companies will only conduct business with companies that protect not only their information but also that of their customers and suppliers, as the fine for non-compliance with the law will be between 2% of revenue and R$ 50 million per infraction.
